First2Contact, LLC. ("F2C”, "WE" OR "US") INTERNET WEB SITE TERMS OF USE

THE TERMS AND CONDITIONS SET FORTH BELOW (THE "TERMS") GOVERN YOUR USE OF THIS SITE ON THE WORLD WIDE WEB. THESE TERMS ARE A LEGAL CONTRACT BETWEEN YOU AND F2C AND GOVERN YOUR ACCESS TO, AND USE OF, THE F2C WEBSITE LOCATED AT WWW.FIRST2CONTACT.COM. (THE "SITE"). IF YOU DO NOT AGREE WITH ANY OF THESE TERMS, DO NOT ACCESS OR OTHERWISE USE THIS SITE OR ANY INFORMATION CONTAINED ON THIS SITE. YOUR USE OF THIS SITE SHALL CONSTITUTE YOUR AGREEMENT TO ABIDE BY EACH OF THE TERMS SET FORTH BELOW. F2C MAY MAKE CHANGES TO THE CONTENT OFFERED ON THIS SITE, AT ANY TIME WITHOUT NOTICE, AND F2C CAN CHANGE THESE TERMS AT ANY TIME BY POSTING A CHANGE NOTICE OF THE UPDATED TERMS OF USE ON THIS SITE AND IF YOU ARE A REGISTERED USER OF THE SITE, F2C MAY SEND YOU AN EMAILOF THE CHANGE. YOUR CONTINUED USE OF THIS SITE AFTER SUCH CHANGES HAVE BEEN POSTED MEANS THAT YOU AGREE TO THE NEW TERMS, EVEN IF YOU HAVE NOT REVIEWED THE CHANGES. THEREFORE, YOU SHOULD CHECK THE TERMS OF USE POSTED ON THIS SITE PERIODICALLY FOR UPDATES AND CHANGES.

 

General Terms 
I understand and agree that this subscription agreement (herein after the "Agreement") constitutes a legal contract entered into by me with First2Contact, LLC ("F2C")

I understand F2C is an independently owned and operated Marketing Subscription Service for real estate firms and other real estate related entities.

I understand F2C’s terms of use and privacy policy are incorporated by reference.

I understand and agree that I signify my acceptance to the terms of this agreement, by clicking the box indicating my acceptance, a purchase order with completed voice confirmation or similar order document that references this agreement. I understand and agree that if I am entering into this agreement on behalf of a company or other legal entity in which case the terms “you”, “your”, “I” or “client” shall refer to such entity.

Delivery of Leads
I understands that any leads F2C receives for my subscribed territories will be forwarded to my email address as they become available. .

I understand and agree that F2C cannot guarantee the speed at which I will receive leads due to the unpredictable nature of the real estate market, in any given area at any given time. Furthermore, I understand that any leads provided to me will not necessarily result in the purchase and/or sale of real estate by the lead.

I understand and agree that I am solely responsible for checking my email account and my F2C member's area for any leads that have been sent to me.

I understand that F2C will notify me via email or text message immediately when any new leads for my subscribed territories become available. I understand that it is not the responsibility of F2C to notify me verbally of any new leads that may have arrived in my e-mailbox or member's area account.

I understand that I can ensure email delivery of leads by adjusting any spam filters I may have activated on my computer. I understand this email shall contain the full lead information as provided as well as F2C contact information should I have questions. All correspondence will be originated from support@first2contact.com.

I understands that I am guaranteed a minimum of 3 leads each month I am subscribed to the service.

I understands that if I do not receive guaranteed amount of leads I must notify customer service three (3) business days prior to my billing date and a free month of service can be added to my account.

Payment 
I understand and agree that any subscription charges made to my account are non-refundable.

I understand and agree that my account will have a recurring billing charge for each consecutive recurring billing period as long as my subscription continues to be active.

I understand and agree that I am willfully entering into this monthly recurring subscription agreement.

Termination of Services 
I understand that I may request to cancel the service at any time by logging into the member's area of First2Contact.com or by speaking with a representative in customer service. Any remaining term of the subscription at the time of cancel shall remain active until the end of said prepaid time.

I understands that I must provide at least three (3) business days notification when requesting a cancelation.

I understand that my account cannot be cancelled early or prorated and when cancelation is requested my account will remain open through the prepaid amount of time.

F2C reserves the right to suspend or terminate your access to the service in the event of your failure to make any payment to F2C within three (3) days after such payment is due. F2C may also terminate your subscription based on any professionalism complaint, redlining or any other unacceptable or unprofessional conduct as determined by F2C.

I agree to indemnify and hold F2C harmless for any liability, costs, or damages (including reasonable attorney fees incurred to enforce this indemnification) resulting from any action initiated by me to dispute, cancel, and chargeback or otherwise reverses any credit or debit card transaction entered into by me pursuant to this Agreement.

Modifications to Terms of Service and Other Policies 
F2C reserves the right to change or modify any of the terms and conditions contained in this Agreement, the service or any policy governing the service at any time by posting the new agreement to the First2Contact site located here: Terms of Use. We will use reasonable efforts to notify you of the changes, which may include posting an announcement on the First2Contact site, informing you through your member’s area, in-product notices or via email. Your continued payment of subscription charges following F2C’s posting or notice of the change(s) will constitute your acceptance of such change(s).
